Prop 8 proponents file suit to nullify 18,000 gay marriages

Well, what a crock of sh*t this is. Don't these people have better things to worry about ? Like their own lives perhaps ?

Today Attorney General Jerry Brown filed his brief with the California Supreme Court arguing that Proposition 8 should be invalidated. At least that's a positive.



<em>"Proposition 8 must be invalidated because the amendment process cannot be used to extinguish fundamental constitutional rights without compelling justification," Brown said in a written statement.</em>
 
I just heard today that the U.S. declined to sign onto a U.N resolution that would decriminalize homesexuality worldwide. Yes, I said DECRIMINALIZE.....and they DECLINED to sign it. WTF !

Jerry Brown asked the state Supreme Court on Friday to invalidate the voter-approved ban on gay marriage, declaring that "the amendment process cannot be used to extinguish fundamental constitutional rights without compelling justification."



<strong>Brown's argument on Proposition 8, contained in an 111-page brief filed at the last possible moment before the court's deadline, surprised many legal experts. The attorney general has a legal duty to uphold the state's laws as long as there are reasonable grounds to do so. Last month, Brown said he planned to "defend the proposition as enacted by the people of California."</em></strong>

What a waste of money this is going to be.
 
This is definitely becoming a circus, because guess what I would do if someone said that my marriage was going to be nullified? I'd sue. I guess we'll keep the lawyers and courts busy for a long time with this issue. What an incredible waste of resources, all because one group of people somehow thinks they are better than another.
 
I was told by a father at my son's preschool yesterday that some sort of decision is supposed to be made on Prop 8 in March. It was a brief conversation so I didn't really get the details. Does anyone else know what is to be decided on?

Equal rights! Give them what they want. Many are good productive citizens and should not be discriminated against. Back of the bus mentality still exists apparently.
 
Yes, today the CA Supreme Court heard oral arguments on the challenge to the Constitutionality of Prop 8. They will make a ruling within 90 days to either uphold it, or nullify it. The other issue at hand will be whether the 18,000 + gay marriages will be nullified if Prop 8 remains in force.



If you thought you saw demonstrations before.....stand by if the bigots win.

I watched some of the oral arguments. Given Justice Kennard's comments, I think it's unlikely the court will overturn Prop 8. I really hope we don't have to wait three months to find out.
 
As sad as I am three sheets, I have to agree with you. I hope I'm not in Europe when the decision is announced.....because I plan on exercising my right to free speech.
 
I'm currently on a conference call with one of the California LGBT organizations. Shannon Minter (lead counsel from NCLR) is fielding questions now...



The message I'm hearing is that it does not sound like we think the court will overturn Prop 8, but will most likely let the 18,000 gay marriages stand.



The drive to get gay marriage on the next ballot is now underway.
 
Honestly, I'll never be able to understand prop 8 supporters. Phobia, perhaps.



Or why not an alternative where NO ONE is recognized as "married" by the gov, but you can file to have your union [with anyone] acknowledged by the state (for tax/property/obligation sharing purposes). Then, people could handle the "marriage" part with their own church/ceremony/beliefs and still refer to themselves as such. I just dont see why the government has ANY business regulating ANYONE's marriage.

It seems that prop 8 isn't likely to be overturned. There is bright side. The marriages that already have taken place likely won't be voided. And everyone on the right side of history can feel content that the acceptance of gay marriage is inevitable. In the long run, the religious right will likely lose this battle.
 
I went to a Human Rights Campaign (HRC) dinner on Saturday night and one of the keynote speakers was Julian Bond, President of the NAACP.



If anyone has about bit of time (25 minutes total!) and would like to listen to a very powerful speech about homophobia/civil rights, etc....here you go. And this is coming from a straight man. Thank you so much, sir.
