Priority list problem with Mendocino UPDATE

We finally decided which home to choose. On Sunday, they confirmed our place on the priority list and the price and elevation.

Today we called them and found out that they have released the phase 28 that we were waiting for. Went there and APPARENTLY, FCB beat us in that home. Although we were on their list from May and actually they said we were on top of the list, today when we went to give the check they told us they are holding the home indefinitely!!!!! for FCB to wire the money from HongKong.

From what we heard, real state agent of the FCB is a friend of one of the Sales consultants and she is pushing it through.

This is the quote from their release email:
"Should you decide to reserve a home we will require an earnest money deposit of $20,000 made out to First American Title. Please remember that we cannot hold homes off the market for any period of time. If we can not reach you when we call, we will continue to make calls and extent the opportunity to purchase to other individuals on the Priority List".

1) We know they are lying about FCB being on their list but we can not prove it since they don't give us their place on the list, and even if they do there is no easy way to verify it.

2) as I stated above quote, they should not hold the home off the market for any reason, when we gave them our check today (we forced them to get the check though).

We called their supervisor Jared A. Miller ( sales manager of Irvine pacific) like 100 times and left messages on his answering machine... no reply yet.

We called the Sales director Daisy Tran left a voice message , No reply yet.

A) What can we do to involve an independent third party to confirm our place and their place in the priority list? I know it is fairly easy to add "A FCB name" in their priority list so this is just a long shot.

B) Who should we talk to know how many days they can hold the home before releasing it to next person on the waiting list?
 
There is no priority list.  If you have cash ready to go...you're first.

They do not have to hold the home for any period of time.  They basically decide who does or does not get the home.

Sorry to tell that to you but it's just the way builder do things these days. 

I am surprised because it seems like there were a few Mendocinos available on the open market.
 
The waiting lists are nebulous at best. They don't have to provide you with any information as to who is ahead of you or isn't. Now, I think that if you're really determined and want to proceed to a lawsuit, some of that information may be discoverable. However, the language in the policies they adhere to on who will be given priority once on the list is quite open to interpretation and crafted in such a way as to allow a builder to sell to whomever they please, regardless of their place on the list.
 
priority list is only there for creating artificial demand, even when there is no demand.

Sorry to hear that, but personal connection or under the table cash trumps everything else, priority list or not.

You should've paid Ms. Ringwald a couple of grand under the table to secure your lot. too late now
 
Just sue them. Make their internal documents/emails discoverable. I bet they will settle even before it gets that far. If it does go that far, invite the whole TI community to the deposition.  >:D
 
IP does not deserve your time and money and don't waste your energy on lawsuit. 

If Mendocino sales can resolve the issue with you, that's great.  Otherwise, I would take the business somewhere else.

BTW, some here at TI think Pavilion Park are better than Stonegate and you should seriously consider it,  just saying.... :)

Mendocino has a process and they do call from the list in the order of priority. If you are called first, you get to choose from the 5-6 homes they release in each phase. Once you have chosen one, they will hold it for you. Then they call the next person down the list until they get another reserved. This process takes a few days.

Mendocino is a great neighborhood and offers a fantastic elementary school. The corner 2X plan (based on the map you shared) that you like has a dramatic entrance that has a wrap around stairway. I have seen one of these completed homes and the entrance takes your breath away. I don't remember seeing another home offering this dramatic look in the other Stonegate or PP communities.

Try to win the sales folks over with a bit of honey instead of vinegar. Appeal to their hearts instead is my best advice.

About the process, that is not true at all since they only have handful of people in their list with no strong interest. That is why they have lots of homes on mls and open market.

About honey and vinegar, lets just say, when you have been lied to in daylight, you just wonder , dont I deserve the truth?



 
We liked Mendocino because of the driveway and the location but did not care for the floorplans at all.  A lot of long walls and odd corners. 

Plan 1 for example has on bathroom for two bedroom and the loft.  If you convert the loft into a bedroom, it would be three bedrooms for one bath.

Yeah... got me too... I don't remember breath taking features in Mendocino. :)

Did the "takes your breath away" part give it away?  I admit thought, I read that, chuckled and went to look at the 2X floor plan so I guess he/she accomplished something by driving page views for Mendocino?

Maybe Berlin was playing in the background when s/he was at the model homes?
