Get Well, Peter. (Add your message here.)

I think its a 2004/2005 Cannondale Six13 Si - Aluminum/CF composite. The photos of his bike are unreal...</blockquote>
I hate saying this, but he should seriously consider suing the bike manufacturer. A bike like that should not be coming apart into 4 pieces mid ride. That's some scary stuff. A lawsuit will open the Company's eyes to this potential fatal defect.</blockquote>

See my post above re manufacturing and design defects, which are product liability claims.

I saw it after my post, I guess I was a little slow. :(

Hi everyone,

Peter will be released tomorrow. Doctors are still concerned with his back, and recommended that he is transferred to a rehab hospital in Orange County (closest one is in Tustin). Peter's doing a lot better this week, and the doctors are being cautious with his recovery.

Thanks,

Vic

Wow. Get well Peter. I always defend mountain biking to people by saying that while an accident on a road bike might hurt like hell or require some stitches, an accident on a road bike can lay you out in the hospital. The unfortunate part is that its not a joke and it happens to people I know. If anyone has any more details on how he's doing, please let us know.

[quote author="roundcorners" date=1245542382]Does anyone else see a lawsuit here? I didn?t know Cannondale started outsourcing to China too? I guess Gypsyuma is our new resident lawyer? I see a couple of scenarios here?

1) Peter can play hardball, hire a top notch attorney and go after Cannondale for all its worth; get reimburse for medical, injuries, mental anguish, the whole nine yards.

</blockquote>

Option #1. Save the bike, get everyone's name who was present, have them take notes on what they remember about anything/everything leading up to the crash, all while this is still fresh in memory. A solid products liability attorney shouldn't be too hard to find. Having basic information preserved and ready for making that step will definitely help things along.

[this is not legal advice, but common sense]

I talked to Peter's wife this morning. He is at a Rehab hospital in Tustin and is doing better than last week but still has quite a ways to go. Not sure how long he will have to be at the Rehab hospital. She said that he would love visits from his friends. Send me a PM if you are interested in visiting him and I can relay the details.

Of course it's legal advice, you are a JD. :p

I can recommend a VERY good product liability attorney in Orange County....PM me if you would like any details....I have personally hired him and he successfully argued a judgement for me....

Just a head's up. We haven't forgotten about Peter and we are working on a meal schedule that will be posted shortly. Thanks to everyone who has offered to help out.

Good luck Peter!

As a new biker, I've been impressed by your accomplishments (century, 6,000+ climbs, etc.). I wish you a prompt recovery and hope you get back doing the things you love as soon as possible.
