It's one of the newer designed houses that has a additional attached minilivingroom and bedroom to the main house- meant for a parent or college kid- part of the house but separate entrance and one door connecting to main house

We are renting the house the owner can rent the side unit which consists of two rooms and a bathroom. New renter smokes. Lease we signed is general ca lease does not mention the side unit at all.

Unless the side units have a different address I believe those rooms should be under you.

What did the new neighbors say when you asked them to not smoke indoors?  What did your landlord say when you explained the situation?

Many cities allow renting out the mother in law or secondary unit if the owner lives in the main unit.  However they dont let both units get rented out as that becomes a duplex.  What city is this in?

NextGen is IRVINE city product.

First, not correct.  Lennar lists nextgen homes in many areas: https://www.lennar.com/nextgen

Second, even if you were right, OP indicated that its like a nextgen house and never said it was a nextgen house.
